Divorce is the term used for the legal dissolution of a marriage. Filing for a divorce does not involve the legal process of dividing property assets nor does it involves children’s matters.  In Australia any party to a marriage may seek a divorce and are entitled to a divorce regardless of their religious beliefs. The only ground for obtaining a divorce is that the marriage has broken down irretrievably.

A divorce can be sought once a married couple have separated for a period of at least 12 months.

In order to seek a divorce, you must make an Application to the Federal Circuit Court and include a certified copy of your Marriage Certificate. A Divorce Order is made final, one month and one day after a Divorce is granted.  Kaberry Family Law can ensure that your Application is in the right form, appropriately signed and witnessed and includes the appropriate affidavits and documents.
